We counsel clients on all aspects of export control and trade regulation matters, including the Export Administration Regulations (EAR) administered by the Department of Commerce, the International Traffic in Arms Regulations (ITAR) administered by the Department of State, and the national security and foreign policy sanctions laws administered by the Department of the Treasury. We also assist clients seeking modifications of problematic statutory or regulatory standards.
Our attorneys advise US exporters on the full range of international technology transfer issues and compliance and licensing matters. We assist clients in preparing and obtaining approval for necessary export control agreements, such as manufacturing license agreements and technical assistance agreements, and in obtaining new registrations under the ITAR, as well as in obtaining specific licenses to give foreign persons in the US access to ITAR-controlled goods and technical data. Similarly, under the EAR, we assist a wide range of clients in obtaining the various licenses required to permit particular exports subject to those rules. As part of this representation, our attorneys counsel clients on controls on business activity, work closely with US companies on voluntary disclosures, and help design internal control programs to ensure proper licensing of exports and re-exports. We also have substantial experience dealing with exports subject to international sanctions.
